End of a fixed-term leaseA lease for a definite term ends on its end date. If it converts to month-to-month, either party may end it on the last day of a month with at least one calendar month's notice (§ 47-16-15(5)).
How notice can be deliveredThe 3-day notice of intention to evict may be served like a summons (personal service). If the tenant cannot be found, the sheriff or a process server may post it conspicuously on the premises (§ 47-32-02).

The notice is 'one calendar month', not exactly 30 days. Under § 47-16-15(4), a lease clause requiring a tenant to give more than one month's notice is enforceable only if the tenant initialed it. If the landlord changes the lease terms, the tenant may leave at month-end on 25 days' notice (§ 47-16-15(3)). Eviction is allowed once rent is 3 days late, and the 3-day notice is a notice to vacate, not a right to cure.

What a North Dakota notice to vacate should include

  • The names of every tenant on the lease and the full address, including unit number
  • The date you are giving the notice and the date the tenancy ends
  • A move-out date that gives at least the minimum notice above, counted from the day the notice is delivered
  • For unpaid rent: the exact amount owed and how to pay it
  • Your name, signature and contact details
  • A record of how and when you delivered it (keep a copy)

Many month-to-month notices must also end on the last day of a rental period, so if rent is due on the 1st, the safest move-out date is the end of a month. Giving more notice than the minimum is fine; giving less usually makes the notice invalid.
